A real estate investor explains what to do if your house is squatted during your summer vacation.

One of the main concerns for many Spaniards regarding housing is illegal occupation. The problem is exacerbated when it comes to a second home, as it's often more difficult to prove that it's actually ours. But what can you do if your home is occupied during the holidays?
TikTok user @sergioexcellencecircle , a real estate investor who shares housing advice on social media, recently addressed this topic. In one of his most recent videos, he explains what steps you should take if you encounter squatters on your property during the summer.
Sergio explains that the first step is to distinguish between a primary residence and a second residence. If a primary residence has been occupied, it would be a case of breaking and entering. In that case, you should go to the police and file a report quickly, as this would allow immediate action.
However, things change if it's a second home, as the squatter could claim that the house had been empty for some time and appeared abandoned. In that situation, the process becomes more complicated, and you'll have to prove that the property was still your home.
To this end, the expert indicates that authorities will focus on five key factors. First, the intention to return , which can be proven with plane tickets or reservations. Second, the existence of personal items or testimony from neighbors confirming that the house was used. Third, utilities in the owner's name with active consumption. Fourth, documents such as deeds, rental contracts, property tax records, or property tax receipts. And finally, the length of time the person has been away, since the longer the time, the more difficult it is to prove that the house is still in regular use.
For this reason, Sergio recommends preparing a folder in advance with basic documentation that can be used in a case like this. Having proof on hand that the house is our property can make things much easier when dealing with a judge or the police.
