The 14th pension is a right that remains in effect for certain pensioners, but not all meet the requirements.
Generally speaking, you must have retired before July 25, 2005, with a pension no greater than 15 times the current legal minimum monthly wage (SMLMV). For those who retired between July 25, 2005, and July 31, 2011 , the limit to access the 14th monthly pension is three times the SMLMV.
To request recognition of the 14th monthly payment, interested parties must submit a letter to the corresponding pension fund. The entity has 15 days to respond. If the request is denied, the pensioner can file a lawsuit against the pension fund.
The process is free and does not require the intervention of a lawyer, although it is recommended to seek advice from university legal offices or from the pension fund itself.
The regulations governing the 14th monthly pension are established in Articles 50 and 142 of Law 100 of 1993, as well as in Legislative Act 01 of 2005. These documents establish the guidelines for determining who is eligible and under what conditions this right can be claimed.
