The number of bankruptcy proceedings opened in Spain between April and June decreased by 21% compared to the first three months of the year; however, compared to the second quarter of 2024, it increased by 25.3%. In other words, the number of individuals or legal entities that were insolvent and therefore had legal proceedings opened to resolve their non-payment situation rose to 12,149 , according to the bankruptcy proceedings statistics published this Monday by the College of Registrars.

The vast majority of debtors involved in bankruptcy proceedings were individuals without business activity —specifically, 9,500 of the 10,714 debtors belonging to individuals. While these debtors accounted for 88.2% of the total, approximately 12%, or 1,435, belonged to legal entities.

Based on the legal form of the bankrupt companies, 93% were incorporated as Limited Liability Companies (1,334 companies). In terms of turnover, 46% of the bankrupt companies are in the lowest turnover bracket (up to €250,000), and only 2.8% exceed €5 million per year.

Voluntary and mass-free contests

Regarding the type of bankruptcy , 12,101 proceedings were voluntary - initiated at the request of the debtor -, which is equivalent to a 21.1% decrease compared to the first quarter of 2025. Necessary bankruptcy proceedings - initiated at the request of the creditor - increased by 17.1%, while no consecutive bankruptcy proceedings were recorded, due to the legal reform introduced by Law 16/2022, according to the registrars.

By type of proceeding , bankruptcies without assets—with few assets to liquidate—experienced a quarterly decline of 21.1%, although they still represent 83.7% of the total. The number of ordinary proceedings also decreased, falling by 25.4% to 12.6% of the total. Meanwhile, special proceedings for microenterprises registered 446 openings, representing a 2.1% increase compared to the previous quarter.

Commerce, the sector with the most open procedures

According to the statistics, the sector with the highest number of bankrupt companies was commerce , accounting for 24% of the total. Cases were next most common in construction, with 16.8% of all open proceedings, and in the manufacturing industry, with 14.6%. Regarding employment, 42.6% of all bankrupt companies have fewer than two employees, and 24% of these have no employees.

In terms of age , 19% of the total bankrupt companies in the second quarter were 20 years old or older, while 59.8% were eight years old or younger. By sector, 57.2% of bankrupt companies in the hospitality industry were less than four years old, closely followed by administrative activities, with 55.2%. On the other hand, 34.7% of industrial and energy companies were twenty years old or older.

The autonomous communities with the highest number of debtors declared bankrupt in the second quarter of 2025 were once again Catalonia (2,934), Madrid (1,680), the Valencian Community (1,608) and Andalusia (1,548), accounting for 64% of the total number of cases.
