What will happen to social security payments from July 2025 if you are a contractor?

If you have a contract for the provision of services , be careful because there will be a modification with the payment of social security, as established in Law 2381 of 2024 or pension reform.
Remember that Colombian legislation requires contractors to be affiliated with the pension and health system.
"No natural person may directly provide services to the State, under the modality of a service provision contract, without being affiliated with the pension and health systems provided for in this Law," the regulations read.

Before Law 2381 of 2024 came into force, contractors had to assume the payment of social security: they attached this form to the collection account so that the contracting entity could make payment for their services.
The change that contractors will have with the payment of social security The pension reform established that the responsibility for payment will not be the responsibility of the contractors only when a condition is met .
"When a worker has more than one employment contract at the same time, each employer must independently make the contributions corresponding to the contributory pillar indicated in this law," the reform stated.

That is, the contractors, whether state entities or companies, will be responsible for paying social security and will deduct the amount paid from the contractor .
"The law has an important novelty in which the contracting company or business has the obligation to deduct the value of that contribution from the worker's monthly fees and send it to the pension entity. That is new. The contracting company now has that administrative burden that it did not have before. This is done so that contractors can contribute," said Saida Quintero, director of the labor area of the Faculty of Jurisprudence at the Universidad del Rosario, in a recent conversation with EL TIEMPO.
This change will come into effect on July 1, 2025 , based on what was approved in the reform.

"The employer who hires the services or contractor will be responsible for the entire contribution even if the discount has not been made to the worker or member," the pension reform added.
What is the contribution percentage? As the Ministry of Health has explained, when a person has multiple contracts, they must add up "the monthly income from all their contracts and calculate 40% on that amount."
The entity said that the amount is used to "contribute to the General Health Social Security System as an independent worker with a service provision contract."

The regulation indicated that if payments are not made within the established time , "a late payment interest will be generated by the employer, contractor or hirer , equal to that which governs income tax and complementary tax."
