Social Security has incorporated a new, specific protection into its benefits system, aimed at a very specific group of workers. This measure, already in effect, introduces a special situation that directly affects the recognition of temporary disability due to common contingencies.
This amendment aims to improve coverage for those undergoing a medical procedure that, although voluntary, involves surgery and a recovery period . The regulation responds to a need identified by the legislator to provide greater security for those acting on behalf of third parties.

According to the Revista de la Seguridad Social (Social Security Magazine) , as of Monday, March 3, a special situation of temporary disability is defined as "the situation in which a worker who donates organs or tissues for transplantation finds himself or herself unable to work during the days in which he or she receives medical care." The measure is included in Law 6/24 of December 20 , published in the Official State Gazette (BOE) on December 21.
As stated in the preamble to this regulation, "it has been deemed necessary to establish a special case of temporary disability (sick leave) with specific protection for the situation of these individuals, who altruistically donate an organ or tissue that will serve to save the life or improve the living conditions of another person."

This new special leave status includes both the days of medical preparation before the operation and the period of hospitalization and recovery until discharge. The financial subsidy is calculated as 100% of the regulatory base applicable to temporary disability due to common contingencies and is paid from the first day of leave.
There is no minimum contribution period required to access this benefit, which will be managed by the INSS , the ISM or the Mutual Collaborator with Social Security , depending on the case.
