The defense of the minor who appears in the sex video that three Real Madrid youth players recorded in 2023 at a beach club in Gran Canaria is seeking a four-year prison sentence for footballer Raúl Asencio , whom they accuse of having shared it knowing that it was taken without permission.
The lawyer representing her has confirmed to EFE that, as a private prosecutor, they have already requested the opening of a trial for crimes of disclosure of secrets and child pornography against the players Juan Rodríguez, Ferran Ruiz and Andrés García , who no longer belong to Real Madrid, and also against Raúl Asencio, who currently plays for the first team of the white club.
The first three are accused of the crime of revealing secrets consisting of recording a sex video without permission, with the aggravating circumstance of having distributed it , and of another of child pornography , since a minor appears in the images, for which reason he requests that they be sentenced to four years and ten months in prison.
Raúl Asencio was not present at the consensual sexual encounter between his three companions and the two young women, but he is charged with revealing secrets and child pornography because he allegedly received the video and showed it to a third person, knowing three things: that it had been recorded without permission, that the victims had asked for it to be deleted, and that one of the girls was a minor.
The second private prosecution, brought by the other young woman who appears in the images, has not yet filed a charge sheet, but the attorney leading it has told EFE that she will formulate a legal classification very similar to that proposed by her colleague.
The Civil Guard was unable to recover the videos of the sexual encounter from the four defendants' cell phones (the investigation refers to five), but it did recover several group chats in which they were allegedly shared, as well as the messages with which the people who received them reacted to the images.
Therefore, the prosecution, led by the complainant, who was 16 years old when the events occurred, will request that several of the people who received and commented on the incidents be summoned to testify at the trial as witnesses.
The events under investigation in this case occurred on June 15, 2023, at the Beach Club on Amadores beach in southern Gran Canaria, when the four players, who were then aged 20 and 21, met three girls, with whom they spent part of the day.
In the order concluding the investigation, the judge in charge of the case from San Bartolomé de Tirajana emphasized that, while everyone was swimming in the pool and sunbathing together, one of the young women told the four defendants that she was 16 years old, so everyone knew she was a minor.
At one point, the minor and another 18-year-old girl agreed to go to a private cabin at the club with Ferran Ruiz, Juan Rodríguez and Andrés García , with whom they had consensual sex, while Raúl Asencio preferred to stay on the sidelines and spend time with another girl in the general pool at the facilities.
When the young women discovered they had been recorded, they demanded that the images be deleted, and Ferran Ruiz erased them from his cell phone in their presence, the court records.
However, he specifies, "either because I had copies in other folders, or because I had already sent them to other people, the videos were preserved" and, at the end of that day, Ferran Ruiz, Juan Rodríguez and Andrés García had those images and shared them with various people through instant messaging applications, sending them to three collective dissemination groups.
Raúl Asencio reappears in this matter almost a week later, on June 21, when -always according to the instructor- he asked Juan Rodríguez to send him one of the videos .
The Real Madrid defender saw it and showed it to a third party , something he himself acknowledges in a voice message he sent to that person days later, the instructor emphasizes. "Hey, bro, I showed it to you because Juan gave it to me," he says in the WhatsApp audio.
After learning of his indictment, Asencio issued a statement reiterating that he neither recorded nor sent any images of the two young women to third parties . "I have not participated in any behavior that violates the sexual freedom of any woman, much less minors," the defense attorney maintains.
