The judge believes that Asencio asked for the sex video knowing that a minor appeared in it and showed it.

The judge who prosecuted Real Madrid defender Raúl Asencio for child pornography and disclosure of secrets sees evidence that he asked the other three defendants in the case to send him the video they recorded while having sex with two girls, aged 18 and 16, and then showed it to a third person.

The investigating judge maintains that Asencio asked another of those involved, former Real Madrid youth player Juan Rodríguez , to send him the video, knowing that a minor (a 16-year-old girl) appeared in it and "knowing that it had been obtained without the consent of the potential victims and kept against their demand that it be deleted," according to the ruling.

According to this ruling, the content of which was reported by the newspaper Canarias 7, one of the suspects, Juan Rodríguez, admitted in a conversation that " he didn't care that one of the possible victims was a minor," according to the report based on an analysis of his messages.

The second fact attributed to the footballer is that, allegedly, after receiving the video on his mobile phone on June 21, 2023, in the form of a one-time WhatsApp message, he showed it to a third person who appears in the case as a witness.

The judicial authority agreed this Wednesday to transform the preliminary proceedings initiated in 2023 against the four investigated into an abbreviated procedure (that is, the completion of the investigation and its conversion into a criminal process with all its consequences) and classifies their actions as allegedly constituting crimes of discovery of secrets without consent and violation of privacy (article 197.1 of the Penal Code), distribution and sending to third parties of the videos without warning the injured parties or their consent (article 197.3) and recruitment or use of minors for pornographic purposes and possession of child pornography (article 189, 1 and 5 of the Penal Code).
