Certainly, according to the analysis of the services of the Var prefecture, requested, this decision "taken in application of article LO 136-1 has no effect on the mandates acquired prior to this decision" , the fact remains that this ineligibility, pronounced for one year, from July 2, 2025, will prevent Mr. Herbault from being a candidate in an election until July 2, 2026.

"I started on the wrong date, I filed my campaign account on September 17, 2024, while the filing deadline expired on September 6. The Constitutional Council applied a decision that I am subject to, which is harsh, but which I respect, underlines the 3rd deputy, director of operations in the private sector, delegated to the public domain, ports, beaches and the coastline. My right to make mistakes, which I defended, was not retained. This is the administrative rigor of campaign accounts and it must be respected."

Timing is not on Frédéric Herbaut's side: "I have been elected to Saint-Cyr since 2008, I was a candidate for Les Républicains in the legislative elections in the 6th constituency of Var in 2024, this decision puts me on standby for a year and will inevitably deprive me of a candidacy on a municipal list in 2026" , he regrets.

It should be noted that the Constitutional Council does not uphold any grievance against Frédéric Herbaut for a campaign account showing an amount of expenditure and income greater than the amount set by the electoral code and for which certification by a chartered accountant was produced after the decision of the National Commission for Campaign Accounts and Public Funding.

In the first round of the 2024 legislative elections in the 6th constituency of Var, Frédéric Herbaut obtained 6.45% of the vote.
