Pagani, construction site slows down: company removed

With a resolution dated July 8 , the Municipality of Pagani formally terminated the contract with Mo.Bi. Costruzioni sas of Ottaviano , the company awarded the contract for the extraordinary maintenance of several public buildings in the city. The decision was made " for serious breach of contract ," following a long series of delays and omissions.

The contract, awarded in February 2024 with a 34.982% discount, included interventions on:

• the coverage of the Civil Protection headquarters
• the “Sant'Alfonso Maria De' Liguori” middle school
• the balconies of a municipal building on Via San Francesco
• the “Sant'Alfonso” Auditorium

The works were due to be delivered on July 31, 2024 , with a deadline of October 1. However, the Municipality had already sent the first formal notices in September, reporting the interruption of the works and the lack of progress on the construction site.

By November, the situation remained unchanged: the theater's parquet flooring and doors were unfinished , with a new formal notice issued on November 15th and a deadline of ten days to complete the work. However, upon expiration, no activity resumed .

The Municipality therefore initiated the process for terminating the contract as early as February 5, 2025. The company did not even show up for the joint inspection scheduled for February 13.

The sole person responsible for the procedure (RUP) , surveyor Giuseppe Panariello , supported by his colleagues Ceruso and Pugliese , drew up a consistency report on 24 March , documenting an alarming situation: work carried out for only 41 thousand euros , compared to the entire expected amount.

The fine calculated by the Municipality for the delays exceeds 11,000 euros . The surety bonds will now be confiscated , the construction site will be cleared , and, most importantly, the other companies participating in the tender will be consulted to ensure the work is completed.

The affair rekindles concerns about the management of local public procurement : chronic delays, lack of controls and serious disruptions that directly impact the safety and functionality of public buildings .

With the halt to work on schools, auditoriums, and institutional buildings, there is a risk of compromising educational, cultural, and social activities essential to the Paganese community. Meanwhile, the Municipality reserves the right to assess further damages to be claimed from the defaulting company.
