The courts suspended the decree that transforms Banco Nación into a public limited company

The courts dealt a new setback to the Government with a precautionary measure on Tuesday. Judge Alejo Ramos Padilla suspended Decree 116/25 that transformed Banco Nación into a public limited company, a previous step to being privatized. However, faced with this measure by La Libertad Avanza (LLA), La Bancaria, one of the unions that brings together bank workers, turned to the courts to block this decision by the libertarian administration and succeeded.
In the document shared by Sergio Palazzo, general secretary of La Bancaria, they establish: "ORDER as an interim precautionary measure the suspension of the effects of DNU 116/25 and ORDER the National State and the Banco de la Nación Argentina to refrain from any action tending to its implementation."
"TO REQUIRE the public authorities sued to produce, within a period of five (5) days, a report that accounts for the public interest compromised by the request for a precautionary measure made by the plaintiff on 20/2/2025 (see art. 4 law 26.854)," adds the ruling signed by Judge Alejo Ramos Padilla of the Civil and Commercial Court No. 2 of La Plata.
In this way, the Government will have five working days to present its arguments against the lawsuit filed against it for the transformation of Banco Nación. It is expected that the Ministry of Justice, headed by Mariano Cúneo Libarona, will present them and advance in this dispute that has as its final objective the transfer of the bank to a private company.
In a post on X, the Minister of Deregulation and State Transformation, Federico Sturzenegger, explained that "Decree 116/25, which transforms Banco Nación into a public limited company, also bears the signatures of @GAFrancosOk and @LuisCaputoAR and allows the bank to improve its transparency and corporate governance ."
In this same sense, the Government highlighted that " the decree also cleans up almost the entire statute by eliminating privileges (for example, Art. 31 which required that judicial deposits be in said institution). Congratulations to @DanielTillard and @HoracioLiendo for having brought the process to a successful conclusion," the official pointed out as some of the arguments of the libertarians to change the type of company of the banking entity.
