Following the US court's ruling on the YPF expropriation case, the Radical Civic Union bloc of deputies submitted a draft declaration rejecting the ruling issued by New York judge Loretta Preska , which ordered Argentina to hand over 51% of the energy company's shares to vulture funds.

The initiative is led by Mendoza legislator Lisandro Nieri , who considered that the US court ruling "seriously compromises national sovereignty and public assets." In the ruling signed by Preska, Argentina is forced to grant 51% of YPF's shares to Burford Capital and other plaintiffs as part of payment of the $16 billion judgment for the 2012 expropriation of the company.

" The ruling disregards Argentine domestic law, particularly Law No. 26,741, which declares the expropriation of YPF shares to be of public interest and expressly establishes the need for authorization from the National Congress for their eventual disposition," the bill added. According to the Radical deputies, the provision "interferes in the internal affairs of a foreign state and violates the principles of international law."

"Judge Preska intends to circumvent this legal requirement by stating that Argentina can modify its legislation or negotiate, which constitutes an unacceptable interference in the powers of the National Legislative Branch," he stated, urging the National Congress to "reaffirm its role as defender of public assets" and "get involved in a situation that directly compromises its constitutional powers." The bill presented by Nieri is signed by Karina Banfi, Julio Cobos, Natalia Sarapura, Pamela Verasay, Fabio Quetglas, Atilio Benedetti, Gabriela Brouwer de Koning, Soledad Carrizo, and Gerardo Cipolini.

Likewise, PRO National Representative Gerardo Milman presented another bill rejecting the ruling, arguing that it entailed "a disproportionate financial burden that was detrimental to national sovereignty." The legislator criticized the "reckless management led by then-President Cristina Kirchner and her Deputy Minister of Economy, Axel Kicillof , who promoted the expropriation of YPF in 2012 without respecting the company's bylaws and without conducting a public takeover bid."

"Although Congress acted in defense of energy sovereignty, the political and legal responsibility for the current consequences falls on the Executive Branch at the time, which promoted a maneuver that ignored YPF's obligations and caused monumental economic damage to the country," Milman stated. The Bullrichista deputy stated that the Argentine justice system should " move forward with the entire process taking place in the Argentine federal court, primarily against the public officials who orchestrated the maneuver ."
