  • Real estate belonging to the Agricultural Property Resource of the State Treasury (ZWRSP) may be sold provided that there are no circumstances excluding the possibility of its permanent disposal.

A farmer from the Warmia-Masuria region is upset that he paid a fortune for three years to lease land from the State Treasury's Agricultural Property Resource (ZOSP), hoping to purchase it, but KOWR refused . The decisive factor was the attractiveness of the land as a potential investment location, potentially significant for economic activation and job creation, or for other investment projects . This impacted the rent, but ultimately prevented the land from being purchased.

Prerequisites for priority in purchasing land from KOWR

The National Support Centre for Agriculture informed wp.pl that the statutory privilege of taking advantage of the priority in purchasing real estate from the WRSP Resource without a tender procedure:

  • is granted to the lessee of real estate who has an actual lease period of at least three years - Article 29, paragraph 1, point 3 of the Act of 19 October 1991 on the management of agricultural real estate of the State Treasury,
  • can only be implemented when the National Support Centre for Agriculture designates a given property for sale by sending an appropriate notification to the authorized person and the contractor responds to the submitted offer within the specified time.

The sale of real estate without a tender to a lessee is not an absolute rule, which will be automatically implemented after meeting the conditions specified in Article 29, paragraph 1, point 3 of the aforementioned Act.

This is a privilege of the lessee, which can be used if the KOWR takes action to prepare the property for permanent disposal.

ZWRSP property may be sold if there are no exclusion criteria, such as:
  • there will be no work on changing the local spatial development plan or the study of conditions and directions of spatial development of the commune,
  • there will be no administrative proceedings regarding the implementation of a public purpose investment,
  • there are no other circumstances that would temporarily prevent its sale.
When selling KOWR real estate, the most advantageous way of distributing it is important

Each time, the decision to sell a property, including without a public tender, to its current tenant, is made after reviewing key documentation, including obtaining the opinions and approvals of public administration bodies, analyzing the property's location and development, its neighborhood, and considering the most advantageous method of disposing of the property. This may have significant implications for economic activation and job creation, or for implementing other investment projects, such as:

  • in the field of residential construction, concentrated residential construction,
  • land development for tourism, recreation and sports purposes,
  • extraction of minerals on an industrial scale,
  • construction of wind farms,
  • located near lakes and other water bodies of particular tourist value, etc.) or whose most advantageous use is for purposes other than agricultural purposes - if they are the subject of a lease - should be designated for sale by open tender, after being excluded from the lease agreement or after the lease agreement expires.
