Ewa Szadkowska: Constant problem with confiscation
The regulations on confiscating cars from road crime perpetrators introduced by the previous government – as is often the case, in response to a tragic accident that outraged public opinion – raised numerous concerns from the outset, including constitutional ones. Among other things, they limited the courts’ discretionary powers by providing for mandatory sanctions (in the form of confiscation of the vehicle or its equivalent) and put drivers who drove relatively cheap cars or cars that belonged to others in a better position.
