Important changes for employees have come into effect. They can take additional maternity leave to care for children. Both mothers and fathers of premature babies can take advantage of the leave.

  • On March 19, the regulations amending the Labor Code came into force. Supplementary maternity leave was introduced
  • An employee, either a female or male, who is a father raising a child, is entitled to supplementary maternity leave immediately after taking maternity leave.
  • This applies to parents of children, including those born before the 28th week of pregnancy or with a birth weight of no more than 1000 g.
  • This means that for every week spent in hospital you get a week of vacation.

On March 19, an amendment to the Labor Code Act came into effect, introducing supplementary maternity leave. MRPiPS reminds us that the new entitlement compensates for:

  • employees - parents of prematurely born children, and
  • employees - parents of children born on time but requiring hospitalization

it is not possible to interrupt maternity leave until 8 weeks after giving birth.

According to the regulations, supplementary maternity leave is taken immediately after the end of maternity leave, at the request of eligible employee parents.

An employee, either a female or an employee - a father raising a child, is entitled, immediately after taking maternity leave, to supplementary maternity leave - in the event of the birth of a child:

  • before completing the 28th week of pregnancy or with a birth weight of no more than 1000 g - in the amount of one week of additional maternity leave for each week of the child's stay in hospital until the 15th week after birth ;
  • after the 28th week of pregnancy and before the 37th week of pregnancy and with a birth weight of more than 1000 g - in the amount of one week of additional maternity leave for each week of the child's stay in hospital until the 8th week after birth ;
  • after the completion of the 37th week of pregnancy and his/her stay in hospital, provided that the child's stay in hospital after delivery will be at least 2 consecutive days, with the first of these days falling in the period from the 5th to the 28th day after delivery - in the amount of one week of complementary maternity leave for each week of the child's stay in hospital in the period from the 5th day until the end of the 8th week after delivery .

In addition, maternity benefit for the period of this leave amounts to 100% of the benefit base.

At the same time, the ministry reminds that when determining the additional maternity leave, the periods of the child's stay in hospital until the end of the 8th or 15th week after birth are added up . In turn, a partial week is rounded up to a full week.

However, in the event of the birth of more than one child at one time, when determining the length of supplementary maternity leave, the weight of the child with the lowest birth weight and the period of hospitalisation of the child with the longest hospitalisation are taken into account.

Additional maternity leave is granted once upon application submitted in paper or electronic form no later than 21 days before the end of maternity leave. The employer is obliged to consider the employee's application.

An application for additional maternity leave to an employee or an employee-father raising a child must include:

  • name and surname of the employee or employee-father raising the child;
  • end date of maternity leave;
  • indication of the period for which supplementary maternity leave is to be granted.

The application must also be accompanied by:

  • a certificate issued by the hospital where the child stayed;
  • a declaration by the employee or the employee-father raising the child about the lack of intention to take additional maternity leave or maternity allowance for the period corresponding to the period of additional maternity leave by the other parent of the child.
