Supreme Administrative Court orders the ascent of Gondomar

Supreme Administrative Court orders the ascent of Gondomar

The Supreme Administrative Court (STA) dismissed the appeal filed in 2014 by the Portuguese Football Federation (FPF), after the court considered null and void the decision that led to Gondomar's administrative relegation in 2009, due to alleged corruption.

This decision was confirmed this Tuesday to the Lusa news agency by the club's president, Álvaro Cerqueira, who added that a possible reinstatement of the football team in the II League, from which it was expelled in 2009, is being discussed with the FPF and the League of Clubs.

In March 2014, the Lisbon District Administrative Court considered the ruling of the FPF's Justice Council (CJ) that dictated the administrative relegation of Gondomar to be null and void, and the federative body appealed this decision.

Eleven years later, in April of this year, the STA denied the appeal filed, and the decision has now become final.

The Lisbon Administrative Court had considered the use of telephone tapping to be invalid in the decision that upheld the relegation of Gondomar, in 2009, from the then II Football League to non-professional competitions, following the sports corruption case known as Apito Dourado.

On June 8, 2009, the League of Clubs' Disciplinary Committee punished Gondomar, which had already been relegated for finishing last in the 2008/09 II Liga, with disqualification and a €78,000 fine, after active corruption was proven in six of the 22 matches in question. Two cases were dismissed, and only attempted corruption was proven in 14.

Gondomar appealed, but the FPF's CJ, in a ruling of June 30, 2009, confirmed the decisions taken by the League's Disciplinary Committee, deeming the appeal unfounded. Last season, the Gondomar club played in Series B of the Portuguese Championship, the fourth tier of national football, but ended up being relegated to the district leagues, after finishing 11th in the competition.
