Why doesn't the transfer of Preta Gil's body fall under the new Brazilian rules?
Preta Gil's family is preparing to bring the artist's body back to Brazil from the United States . Gilberto Gil's daughter died this Sunday, the 20th, at the age of 50, after a fierce battle with bowel cancer, which was diagnosed in January 2023.
The singer had been in New York since May, when she began a new treatment after exhausting all available options in Brazil. Despite her trips to and from the hospital, the singer remained optimistic. "I'll return cured, God willing," she said before leaving the country.

After the announcement of her departure, Gilberto Gil expressed his regret and stated that the family is handling the repatriation procedures for Preta's body . In this case, the Brazilian Consulate General should be informed to take legal action regarding documentation. The family should present:
- Certificate of transfer of the body;
- Original Death Certificate;
- Embalming Certificate;
- Health certificate of non-contagious disease.
On June 26, following the repercussions of Juliana Marins' death , President Luiz Inácio Lula da Silva issued an order modifying immigration law and allowing, "on an exceptional basis," the payment of transfer expenses. However, Preta's case does not meet the four conditions:
- Proven financial incapacity of the family;
- The expenses are not covered by insurance or provided for in an employment contract (if traveling for work);
- Death occurs in circumstances that cause commotion;
- There is budget and financial availability.

The artist had been undergoing treatment for bowel cancer since January 2023. The news of her death was confirmed to Terra by her team this Sunday. In May, Preta traveled to the United States, where she began new treatment after exhausting all available options in Brazil.
Gilberto Gil's daughter with businesswoman Sandra Gadelha, Preta leaves behind Francisco Gil, 30, as her heir, the product of her relationship with Otávio Muller. Her son is a member of the musical group Gilsons, and continues the family's musical talent.
According to columnist Léo Dias, Preta fell ill on the way to the airport. She was supposed to return to Brazil; an ambulance was called, but she died on the way to the hospital.
