It has become known how the property of divorced Andrey Merzlikin can be divided

Russian actor Andrei Merzlikin divorced his wife Anna on Family, Love and Fidelity Day. The couple has four children, three of whom are underage. The publication "Passion" found out the prospects for dividing joint property in the event of a court case, contacting lawyer Sergei Zhorin.

Although Anna is raising three minor children, she will not be able to claim a share of more than half of the property. As Zhorin explained, in the absence of a marriage contract, the property is divided equally. Children do not participate in the distribution of assets. The court will take into account the presence of minors when determining the order of division, but not the proportions.

For example, if the spouses have one large apartment and the children stay with their mother, the property can be assigned to Anna. However, half of the cost of the housing will have to be compensated to the former spouse. As the lawyer noted, compensation is possible with other assets.

It is specified that judges rarely deviate from the principle of equal distribution. An exception may look like this: if there are two apartments of 90 and 100 m², the court has the right to transfer the larger of them to the mother and children, Zhorin explained.
