Union warning about summer vacations: Companies can't use this 'trick' to shorten them

The most anticipated moment for millions of workers is approaching: summer vacation, a time to rest after many months of work. A right that, like all others recognized by law, is irreplaceable and must be respected regardless of any corporate pressure.
The USO (Union Sindical Obrera) union has issued an alert on its TikTok channel to inform the most unsuspecting that companies cannot prohibit their workers from taking vacations, as it is an inalienable right.
The union refers to Article 38 of the Workers' Statute ( you can consult it at this link ), which establishes that all employees are entitled to annual leave and that " in no case shall the duration be less than thirty calendar days ." This amount may be 22 working days, if specified in the agreement.
In this regard, the union insists that no company can refuse to allow an employee to go on vacation, and that it cannot use a trick already known to many employees: paying for vacation instead of allowing them to take it. USO warns that " they cannot pay you vacation instead of giving it to you, unless you leave the company ."
The union once again cites the Workers' Statute as a defense, which makes it clear that this vacation period is " non-replaceable with financial compensation ." Otherwise, the worker will have the right to file a claim.
It is important to remember that employees must be informed of their vacation time at least two months in advance , an obligation based on the need to guarantee employees a margin for self-organization.
