A mess in the statutes of local government units. The Ministry had no idea about the problem

The Association of Polish Counties reported a problem concerning the nature of the statutes of local government organizational units . As noted, some voivodes question the statutes of such budgetary units, claiming that they should have the nature of local law. Some administrative courts also agree with this assessment.
In turn, other voivodes take the position that the statutes of budgetary units are internal acts. This opinion is shared by the Union of Polish Cities . The topic came up during a meeting of one of the teams of the Joint Government and Local Government Commission.
The problem came to light with the new law on the labor market.

As she explained, because of the aforementioned act, county councils must adopt new statutes of labor offices. It turned out that in the whole of Poland 50 offices have their statutes as local law acts, and the rest were adopted as "ordinary" resolutions.
The regulations need to be amended accordingly. There are two possibilities- However, looking at Article 11 of the Public Finance Act, it is difficult to conclude from this provision that these should be acts of local law - noted Bernadeta Skróbel.
ZPP expects the law to be changed so that the practices of voivodes in this area are unified. According to the union, the appropriate regulation should be included in the Public Finance Act or in the provisions of local government acts .
As we read in the ZPP report from the team meeting, the representatives of the Ministry of Internal Affairs and Administration present at the scene admitted that it was the first time they had heard of such a problem.
However, they assured that in the "near future" they would organize a meeting with representatives of the voivodes' legal supervision to discuss the matter.
