There are two notifications regarding the disclosure of recordings from operational control

The National Prosecutor's Office has received notifications regarding the disclosure of recordings from operational control; one from Roman Giertych, the other from the CBA - the National Prosecutor's Office informed on Tuesday. They concern recordings of Giertych's conversations with, among others, Donald Tusk. The next stage of the case will be handled by the prosecutor's office in Białystok.

"The National Prosecutor's Office has received two notifications of suspicion of committing a crime of disclosing materials from operational control," the spokesman for the National Prosecutor's Office, Przemysław Nowak, informed on Tuesday afternoon. He added that they concern recordings of conversations with the participation of, among others, Giertych, published since June 13 of this year.

The case concerns a recording of a fragment of a conversation between Giertych and Tusk from 2019, revealed in recent days by Telewizja wPolsce24 and TV Republika , which concerned, among other things, electoral lists and negotiations with the then head of PO Grzegorz Schetyna regarding Giertych's run in the parliamentary elections.

The spokesman for the Prosecutor's Office stressed that the notifications in this case submitted by Giertych and the CBA will be forwarded to the Regional Prosecutor's Office in Białystok - as stated by prosecutor Nowak - "in order to designate a prosecutor's office unit competent to examine them in court".

According to information from prosecutor Nowak, Giertych also accused CBA officers of illegally using Pegasus software in 2019 to record his conversations , including with Donald Tusk, and transferring these recordings to unauthorized persons – which he qualified as an abuse of power by a public official and illegally obtaining information. In addition, Giertych accused TV Republika journalists of publishing these materials, which he considered a crime of disclosing illegally obtained information.

In turn, the CBA filed a separate notification in the same case, but it was covered by a confidentiality clause – its content was not disclosed by the PK.

The spokesman for the Ministry of the Interior and Administration, Jacek Dobrzyński, announced on Tuesday evening that the CBA notification concerns the disclosure of classified information and the dissemination of information from preparatory proceedings. "The notification concerns the possibility of disclosing operational materials made available in 2020 to the then national prosecutor and recently published in some media," Dobrzyński wrote on the X platform.

The PK spokesman also recalled that the investigation into the abuse of power and failure to perform duties by public officials in connection with the use of Pegasus software as part of operational control is being conducted by Investigative Team No. 3 of the National Prosecutor's Office. In this investigation, Roman Giertych has the status of an injured party.

According to Giertych, who referred to the CBA statement in this case, his conversations were to be destroyed because they did not contain any content of a criminal nature. Meanwhile, as he pointed out, copies of the recordings were taken out before the change of government and are currently being used for political purposes by people associated with PiS. (PAP)
