Purchasing a land plot without a full check of the documentation can lead to legal disputes or loss of property. Land and real estate lawyer Elena Pyatachenko told the Prime agency about this.
The specialist emphasized that it is critically important to have officially registered rights to both the land and the buildings located on it.
According to her, there are often situations when the seller is only registered for the land, and the house is built without permission and is not included in the register. In the event of a conflict, such a building will not be recognized as an object of property rights, which excludes its sale, inheritance or reconstruction, she said.
The expert advises to check the plot for encumbrances (for example, a pledge, arrest) before the transaction. It is also worth making sure that there are no disputes over the boundaries of the plot and studying the history of the transfer of property rights.
To minimize risks, the expert recommends conducting a legal audit of the property with the involvement of a specialized lawyer and notary. This will allow identifying hidden problems before signing the contract, Pyatachenko said.
