Cristina Kirchner asked to reopen the case against Gerardo Milman

Cristina Kirchner requested before the Federal Court that the case involving Gerardo Milman in the 2022 attempted murder be reopened. The hearing was attended by the former congressman, who requested that the charges against him be dismissed. The final ruling has not yet been issued.
Lawyer Marcos Aldazabal described Judge María Eugenia Capuchetti's decision as "arbitrary" and "surprising." He argued that the judge closed the investigation without evaluating all the evidence.
The case indirectly linked Milman to the planning of the attack. The suspicion arose from statements made by Jorge Abello, an advisor to the Kirchner administration in the Chamber of Deputies. According to Abello, the former deputy had said in a bar across from Congress: “When they kill her, I’ll be on my way to the coast.”
Aldazabal asserted that the case was premature. He explained that there were still pending evidentiary measures and criticized the ruling's weak justification. He said the judge merely transcribed Milman's testimony, given in May, when he spoke for more than five hours before the court.
Milman's lawyer, Mauricio Castro, maintained that his client cooperated fully. He stated that the phone handed over to the authorities was not the same one he had in 2022, but argued that this fact did not change the case.
Castro added that the investigation should determine whether anyone had financed or encouraged the perpetrators of the attack. “It seems clear that no one financed these individuals,” the lawyer stated.
He also noted that all the witnesses who were in the bar denied having heard the phrase attributed to Milman. Judges Leopoldo Bruglia, Mariano Llorens, and Pablo Bertuzzi will decide whether to reopen the case or uphold its closure.
Meanwhile, Jorge Abello is under investigation for perjury. The advisor testified 23 days after, according to him, hearing Milman's words. He asserted that the former congressman had prior knowledge of the attack against Cristina Kirchner.
None of the people who were with him confirmed that version of events. The message he claimed to have sent to his boss, Congressman Marcos Cleri , was also not found on his phone.
Judge Capuchetti still has to decide on Abello's legal status. Meanwhile, the Federal Court is reviewing the requests from Kirchner and Milman. Both are seeking to overturn the dismissal, though with opposing aims: she wants to reopen the case, while he seeks its definitive dismissal.
