Conditional discontinuation of proceedings against one of the accused in the case of a road accident near Konotop

In the trial of five defendants in the case of a road accident near Konotop, the court issued a sentence against one of them, an employee of the diagnostic station Jan S. It conditionally discontinued the proceedings for a probation period of two years - Sławomir Przykucki, the spokesman of the District Court in Koszalin, told PAP.
The trial of a truck driver, the owner of a transport company from Piła, his two employees and an employee of a diagnostic station, who were charged by the District Prosecutor's Office in Drawsko Pomorskie in the case of a road accident near Konotop, started before the District Court in Koszalin on May 20 this year.
At the first hearing, presiding judge Sylwia Dorau-Cichoń did not grant the motion of the defense of the accused diagnostician Jan S. to exclude his aspect of the case for separate proceedings. However, she did not rule out considering, at one of the subsequent dates, the second motion of the accused's defense, agreed with the prosecutor, to conditionally discontinue the case against him, taking into account the insignificant harmfulness of the act he is accused of.
The prosecutor's office accused Jan S. of confirming untruth in the documents while conducting technical inspections of the vehicle. He did not verify the consistency of the VIN number with the registration number of the semi-trailer, stating that it was operational and could be approved for traffic.
"The court conditionally discontinued the proceedings for a probation period of two years. It ordered the accused to pay a cash benefit of PLN 5,000 to the Fund for Aid to Victims and Post-Penitentiary Aid," said judge Przykucki.
He informed that the verdict is waiting to become final. The trial of the remaining defendants is still ongoing. The next hearing dates are set for January 2026.
Marcin B., a 26-year-old truck driver, is facing trial for causing the land disaster. According to the prosecutor's office, he failed to adjust to weather conditions and speed limit signs, was driving too fast, and in a faulty vehicle. The man was sober at the time of the incident.
The prosecutor's office charged the owner of a transport company from Piła, 30-year-old Adam K., who owned the vehicle, and two of its employees, Roman K. and 27-year-old Maksymilian F., with deliberately causing a real risk of a catastrophe in land traffic. According to the investigation, they actually managed the transport, allowed the truck with a faulty semi-trailer to be driven, which had a faulty brake system, damaged tires, did not have valid technical inspections, and did not have the correct registration plate. The plate was to be replaced. In the prosecutor's opinion, the accused acted together and in agreement.
The accused stand trial on bail.
The disaster occurred on September 13, 2023 after 4 p.m. on provincial road No. 175 near the town of Konotop (West Pomeranian Voivodeship). A truck collided with a PKS regular bus, in which young people were returning from school in Kalisz Pomorski to their homes in Drawsko Pomorskie.
17 people were injured in the bus, including the driver, who was most seriously injured. He was transported by LPR helicopter to a clinical hospital in Szczecin, where, despite doctors' efforts to save his life, he died. The passengers suffered moderate and minor injuries, including: bruises, concussions and fractures. The truck driver did not suffer any injuries. The first at the scene of the crash were Polish, American and Czech soldiers, who were leaving a nearby training ground at the time. They provided first aid to the injured. (PAP)
