Plans to freeze electricity prices have changed. Additional fees are looming.
  • The Sejm passed a law providing, among other things, for the freezing of energy prices at PLN 500/MWh until the end of the year.

At the end of June, the Sejm passed an amendment to the so-called Wind Farm Act , which, among other things, reduces the minimum distance between wind turbines and buildings to 500 meters. The act also unexpectedly included provisions freezing energy prices at PLN 500 net per MWh until the end of the year. The bill is now scheduled to be considered by the Senate. Current regulations stipulate that the price freeze will remain in effect until the end of September.

However, it is not known whether the bill will be signed by President Andrzej Duda, who is not in favor of changes to the regulations regarding wind farms .

Meanwhile, according to praw.pl, some electricity sellers offer customers a contract with a frozen price guarantee.

The sample contract assumes that the current price of PLN 500/MWh will also apply for the specified period after September 30th. To take advantage of this solution, the customer must usually meet certain conditions, such as purchasing additional services or committing to a commercial fee that will be added to their bill.

However, the question arises: what if a statutory freeze on electricity prices succeeds? Will those who have signed appropriate agreements with suppliers still have to pay additional fees?

Martyna Popiołek-Dębska, a legal advisor at the MPD law firm, explains in an interview with praw.pl that "if a consumer voluntarily entered into a contract with an energy supplier (e.g., accepted a new tariff with a commercial fee or a service package), the contract is valid – even if it later turns out that the price freeze was extended. "In such a case, the law does not provide for automatic termination of the contract," the expert emphasizes.

If the regulations regarding the freezing of electricity prices for the period October-December 2025 come into force, in my opinion this does not give consumers the right not to pay or to seek a refund of additional fees, confirms Małgorzata Miś, president of the Aquila Consumer Protection Association.

An exception - according to experts - may be contracts containing provisions according to which the contract ceases to apply in the event of an extension of the price freezing mechanism.
