  • According to some lawyers, such a drastic restriction of property rights without the right to compensation may violate the Constitution of the Republic of Poland.

Local governments must prepare general plans . They are to replace the previous studies of conditions and directions of spatial development.

After that time, it will be possible to adopt local spatial development plans and issue location decisions if a general plan has entered into force in a given commune. What exactly is this about?

  • The general plan of the commune with the rank of an act of local law must be adopted for the entire area of ​​the commune; communes have time to adopt it until 30 June 2026;
  • the previous deadline of 1 January 2026 was extended following the amendment to the Spatial Planning Act ;
  • The implementation of the reform is one of the tasks co-financed by the KPO.

The issue is causing such great concern that offices are facing a large increase in the number of applications for development conditions under the current rules. People do this so as not to have any potential problems with building a house after the adoption of the general plan of the commune.

These general plans will indicate exactly where it will be possible to build houses and where this will never be possible again.

Poles are becoming aware that their plot of land may become worthless if they do not apply for the issuance of development conditions under the old rules - warns prawo.pl.

Therefore, property owners submit applications to municipalities for the issuance of development conditions .

It is also possible that the reduction in the supply of land for residential development following the adoption by municipalities of general plans according to the new rules may result in an increase in plot prices in the second half of next year.

According to some lawyers, such a drastic restriction of property rights without the right to compensation may violate the Constitution of the Republic of Poland. Maciej Górski, attorney, partner at GPLF, said in an interview with prawo.pl that today it is possible to effectively request the issuance of a decision on development conditions.

- The general plan, however, may deprive this possibility. And this argument cannot be ignored, because depriving property owners of the possibility of obtaining a decision on development conditions undoubtedly causes damage to their property, which we can prove. The amended act on spatial planning and development does not provide for compensation in such a situation, and even excludes it. This is where the unconstitutionality can be seen - he noted.
