INSS fraud: retirees will start receiving reimbursement in July; see the schedule

Retirees and pensioners affected by INSS fraud will start receiving their money back from July 24. The announcement was made this Tuesday 24 by the president of the agency, Gilberto Waller, during a conciliation hearing at the Supreme Federal Court, led by Minister Dias Toffoli.

According to the initial schedule, the reimbursement will be made in a single installment , with monetary correction, directly into the bank account where the beneficiary receives his/her retirement or pension. Every 15 days, a new batch of payments will be released, starting with approximately 1.5 million people in the first group. The second batch is scheduled for August 9 and the third for August 24 .

The government intends to complete all payments by 2025. To this end, it plans to create an extraordinary credit outside the spending cap, enabling the use of public resources before the recovery of the amounts diverted by the entities involved in the frauds.

The operation will be carried out in a staggered manner, with priority given to vulnerable groups, such as the elderly over 80 years old, indigenous people and quilombolas.

The president of the INSS reinforced that there is no deadline for contesting. “As long as there are people who have not spoken out, we will not turn the tables on them. We are monitoring the situation, including an active search,” said Waller.

Full refund

During the hearing at the STF, Minister Dias Toffoli, the case's rapporteur, said that any solution to the losses caused by the fraud must guarantee the full return of the amounts diverted from retirees and pensioners.

“The solution must involve full restitution of the funds diverted to those who were harmed. This report does not abandon this premise,” the minister declared. He made it clear that the search for a quick solution does not exempt the public, private or legal agents involved from responsibility .

Toffoli also temporarily suspended the statute of limitations for legal actions brought by victims, allowing them to wait for a solution without losing their right to compensation. On the other hand, he denied the request by the Lula (PT) government to suspend ongoing lawsuits against the Union and the INSS.

The case numbers

The fraud was revealed by Operation Sem Desconto , by the Federal Police and the Comptroller General of the Union, and involved unauthorized discounts made by unions, associations and entities on the benefits of millions of people from 2019 to 2024.

Investigations indicate that retirees and pensioners were included as members without consent, using forged signatures, in a scheme that diverted around 6.3 billion reais.

Around 9 million beneficiaries may have been affected. So far, 3.4 million have formally contested the discounts and requested reimbursement. According to the Attorney General's Office, the government would already have the technical conditions to return the amounts to 1.2 million people immediately .

At the same time, the number of lawsuits filed against the INSS and the Federal Government is growing rapidly. There have already been more than 65,000 lawsuits filed between January 2024 and May 2025 alone. This number is expected to double with the judicialization of cases related to illegal deductions.
